1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Roberto Franco ("we", "us", or "our") concerning your access to and use of the www.robertolanguageteacher.it website and our Italian language teaching services, including the student hub portal (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. Services Description

Roberto Franco provides Italian language instruction through:

• One-on-one lessons: Private Italian language lessons conducted online (via Zoom, Google Meet, or similar platforms) or in-person in Lecce, Puglia, Italy
• Student Hub: A secure web-based portal where students can access lesson materials, track progress, view schedules, and manage their account
• Learning Materials: Custom lesson content, practice exercises, and educational resources tailored to individual student needs
• Scheduling Services: Lesson booking and calendar management through our website and Calendly integration

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice to active students.

3. Account Registration and Access

3.1 Student Accounts

To access the student hub and book lessons, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials and accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach
• Not share your account with others or allow others to access your account

3.2 Age Requirements

You must be at least 13 years old to create an account. Users under 18 must have parental or guardian consent to use our Services. We reserve the right to request proof of age or parental consent.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity. You may close your account at any time by contacting us.

4. Lesson Booking and Payments

4.1 Lesson Packages

Lessons are offered in packages or individual sessions. Current pricing and package options are available on our website and subject to change with notice.

4.2 Payment Terms

• Payment is processed securely through Stripe and must be completed before lesson access is granted
• All prices are in Euros (EUR) unless otherwise stated
• Payment for lesson packages must be made in full before the first lesson
• You are responsible for any bank fees, transaction fees, or currency conversion charges

4.3 Refund Policy

Our refund policy is as follows:

• Cancellation by Student: Lessons cancelled with at least 24 hours notice may be rescheduled at no charge. Lessons cancelled with less than 24 hours notice are non-refundable
• Unused Lesson Credits: Unused lessons in a package may be refunded on a pro-rata basis if requested within 6 months of purchase, minus a 20% administrative fee
• Technical Issues: If we are unable to deliver a lesson due to technical issues on our end, you will receive a full refund or credit for that lesson
• Dissatisfaction: If you are unsatisfied after your first lesson, you may request a full refund within 7 days of that lesson

4.4 Rescheduling

Lessons may be rescheduled by either party with at least 24 hours notice via email or through the student hub. We will make reasonable efforts to accommodate your preferred schedule.

5. Student Responsibilities

As a student, you agree to:

• Attend scheduled lessons on time with necessary materials (device with camera/microphone for online lessons)
• Maintain a respectful and professional demeanor during lessons
• Complete assigned homework and practice exercises to the best of your ability
• Provide feedback and communicate any learning difficulties or concerns
• Ensure adequate internet connection for online lessons (minimum 5 Mbps recommended)
• Not record lessons without prior written consent from the instructor

6. Intellectual Property Rights

6.1 Our Content

All lesson materials, course content, website design, logos, and educational resources (collectively, "Content") are the exclusive property of Roberto Franco and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use lesson materials solely for your personal, non-commercial educational purposes. You may not:

• Reproduce, distribute, or publicly display any Content without written permission
• Sell, rent, lease, or sublicense any lesson materials or resources
• Use Content to teach others or create derivative works
• Remove or alter any copyright or trademark notices

6.3 Student-Created Content

Any written exercises, recordings, or work you submit during lessons remain your property. However, by submitting such work, you grant us a license to use it for educational purposes, feedback, and service improvement.

7. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Violating laws, regulations, or third-party rights (including privacy and intellectual property rights)
• Transmitting viruses, malware, or any other harmful code to our systems
• Attempting to gain unauthorized access to our systems, accounts, or networks
• Using the Services for any commercial purpose without our written consent
• Harassing, abusing, or harming another person or entity
• Impersonating any person or entity or falsely representing your affiliation
• Interfering with or disrupting the Services or servers connected to the Services
• Using automated systems (bots, scrapers) to access the Services

8. Disclaimers and Limitation of Liability

8.1 Service "As Is"

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

8.2 No Guarantee of Results

While we strive to provide high-quality Italian language instruction, we cannot guarantee specific learning outcomes or language proficiency levels. Your progress depends on many factors, including your effort, practice, and dedication.

8.3 Limitation of Liability

To the maximum extent permitted by law, Roberto Franco shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of the Services
• Any bugs, viruses, or other harmful code transmitted through the Services
• Any errors or omissions in content or materials

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Roberto Franco and our affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

10.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services:

• Informal Resolution: We encourage you to first contact us at info@robertolanguageteacher.it to attempt to resolve the dispute informally
• Mediation: If informal resolution fails, parties agree to attempt mediation before pursuing litigation
• Jurisdiction: Any legal action shall be brought exclusively in the courts located in Lecce, Puglia, Italy

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify active students via email
• Display a prominent notice on our website for at least 30 days

Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Roberto Franco regarding the Services and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
